| Title | RESUMEN Colombia ha sufrido por un largo tiempo de un conflicto interno que ha permeado no solo la esfera política, sino también la cultural, la social y la económica. En diversas ocasiones se ha buscado la salida al conflicto empleando para ello distintos medios: la confrontación armada y las negociaciones o diálogo con los grupos al margen de la ley, pero al día de hoy, todos esos esfuerzos han sido inútiles y desafortunadamente la problemática perdura. En ese escenario, aparece la justicia transicional como una herramienta de tipo jurídico que busca crear las condiciones más favorables para todas esas sociedades que pretenden dejar de lado la guerra y pasar a un estado pacífico. Sin embargo, a la par de las personas que apoyan activamente este tipo de medidas, se encuentran también los detractores, en el desarrollo de este escrito, abordaremos los dos puntos de vista en concordancia con el ordenamiento jurídico colombiano. |

| Title | ABSTRACT Colombia has suffered for a long time an internal conflict that has permeated not only the political sphere but also cultural, social and economic. On several occasions we have sought the solution to the conflict using various mechanisms: the armed conflict and the negotiations or dialogue with groups outside the law, but today, all these efforts have been unsuccessful and unfortunately the problem persists. In that scenario, transitional justice appears as a legal tool that seeks to create the most favorable conditions for all those societies that look forward to put aside the war and move to a peaceful state. However, the few people who actively support such measures, opponents are also in the development of this paper, we will address the two points of view in accordance with the Colombian law. |
